Grieving mum, 71, set to be evicted from the house she’s lived in for 52 years after plans approved to turn it into a children’s home

A 71-year-old grieving mother, Marie Hargreaves, faces eviction from her home of 52 years after her landlord, Jade Sherlock, secured planning permission to convert the property into a children's home. Marie, who suffers from mental health issues, sold the house four years ago but continued living there as a tenant. The court upheld the eviction, leaving Marie devastated and without guaranteed local accommodation.

Marie Hargreaves, 71, will be forced to leave her Dowry Street home in Fitton Hill tomorrow after Manchester County Court issued an eviction notice ending her tenancy of four years at the property she had owned for nearly five decades.

The 71-year-old, who suffers from anxiety, depression and PTSD, sold the house four years ago but remained as a tenant in what landlord Jade Sherlock described as a temporary arrangement. Last September, Ms Sherlock obtained planning permission from Oldham council to convert the private dwelling into a residential children’s home for up to two children and two carers.

“I followed every step of the legal process carefully and in full compliance with the law,” Ms Sherlock stated. “The possession order was granted after I served the proper notice under Section 21 of the Housing Act 1988. The courts reviewed the case thoroughly and upheld my right to regain possession of my property at every stage.”

Gary Leese, 61, who cares for Mrs Hargreaves, is fighting to stop or postpone the eviction through Manchester Civil Justice Centre. “Marie does not have the capacity to deal with things in her daily life,” he explained. “To be told she has to leave her beloved home has devastated her. It’s the only home Marie’s ever known. She is very confused about the situation and she doesn’t have anywhere else to go.”

Mr Leese has obtained four medical reports from psychiatrists confirming Mrs Hargreaves lacks the mental capacity to handle daily life decisions. The council has warned there is no guarantee of emergency temporary accommodation within Oldham borough if she becomes homeless. Mrs Hargreaves was already devastated by the 2022 death of her son Lee Carter, 48, who was found in a Stockport car park after a week-long search.
